Answer to Question 1

The Secretary may bypass the formalities of the Act and create temporary emergency standards when it is believed that workers are in grave danger from exposure to toxic substances or other newly discovered hazards. Death or injury need not occur before a temporary emergency standard is promulgated, but there must be a genuinely serious emergency before a temporary standard can be issued.
