Answer to Question 1

The company had to expend resources to advertise, recruit, hire, and train replacement workers. It was thereafter required to recall to work all of the unfair labor practice strikers, with partial back pay, necessitating the layoff of the replacement workers. Moreover, it expended significant economic resources on legal fees, and it wasted untold managerial effort managing through the strike litigation process.

Answer to Question 2

Providing information to employees on how to decertify a union is basic employer free speech so long as it is in response to employee inquiries. No charges were issued by the NLRB that anything was improper about providing information to employees upon their request.
