Eminent domain is the power of the government to take private property for public use, without the owner's consent, and upon payment of just compensation. The power of eminent domain is derived from the Fifth and Fourteenth Amendments of the Constitution. The power of eminent domain belongs to federal, state, and local government and can be granted by the government to certain businesses and agencies providing public services, such as utility companies. Eminent domain is proper whenever the government takes property that will benefit the general public.
