Answer to Question 1

No, the Supreme Court held that the replacement of employees in an existing bargaining unit with those of an independent contractor to do the same work under similar conditions of employment is a mandatory subject of bargaining under Section 8(d). However, the Court stated that this decision was not intended to extend mandatory subjects to all contracting out or subcontracting situations.

Answer to Question 2

It ordered the company to reinstitute the operation with its own employees, to reimburse them for any lost earnings from the date of the supplemental decision, and to bargain over the contracting-out matter.
