Answer to Question 1

The record supported the determination that she had a reasonable basis to believe she was the victim of sex discrimination. The employer hired Tim Mack, who lacked any experience in the tire business, at 40 per hour more than Ms. Umbarger, even though his duties entailed many of her duties.

Answer to Question 2

The analysis is a two-part approach. First, an objective standard as to the reasonableness of the employment dispute must be applied; and, second, a determination of the reasonableness of the employee's efforts to resolve the dispute before leaving the employment must be made.
