Hoffman eliminated back pay as a remedy to undocumented workers. That is, undocumented workers are not entitled to pay for time lost after their termination. The plaintiff Singh did not seek back pay. Rather, he sought and received an award covering unpaid wages for nearly three years. This fact pattern was not before the Supreme Court in Hoffman.
