The Court determined that Dr. Ortega had a reasonable expectation of privacy. However, the inquiry does not stop with the determination of such an expectation on the part of the employee. The Court was also required to balance the legitimate interests of the employer against the employee's privacy interest. And in doing so, it established the rule of this case.
