Pretext is a reason given for an employer action that is not the true or real reasons for the employer action. In the Adams case, the jury believed that the manager provoked the employee by intimidating and continuing a verbal confrontation until the employee said something that the manager would use to fire the employee. The pretextual reason being that the threatened the manager; the actual reason was that the cook called the Department of Health about the situation in the kitchen, which resulted in the restaurant having to be closed for the evening.
