Judge Selya was correct in his concluding remarks. Indeed the quality of a person's work performance and not how the person looks should be the fundamental standard for employment decisions. Ms. Cook had a spotless record in her prior employment for the Department of MHRH. This should have been a compelling factor in the rehiring decision.
