Less than 2 percent of the craft workers at the Gramercy plant were black, and despite the fact that 39 percent of the surrounding population was black, Kaiser was having no success recruiting additional black craft workers to fit the established criteria. Not only was Kaiser subject to Office of Federal Contract Compliance Programs pressure, but there was a possibility of a Title VII suit by blacks challenging selection procedures that may have an adverse impact on the black applicants. The obvious answer to Kaiser's problem was a training program. If Kaiser followed strict seniority, very few blacks would be selected for its training program. The union would not, however, let Kaiser ignore seniority. Thus the parties compromised, and dual lists were established. One list was of black employees in order of seniority, the other of whites. Candidates for the training program were selected alternately from each list.
