What is a mixed motive case? Give an example from the text.

A tenant renting an apartment under a three-year written lease that does not contain any specific restrictions may be evicted for:
 a. Counterfeiting money in the apartmen
  b. Keeping a dog in the apartment
  c. Failing to maintain a liability insurance policy on the apartment
  d. Making structural repairs to the apartment

A mixed motive case is one where an employment decision is made, such as failure to promote or hire because of a legitimate business reason where an illegitimate reason also exists and could be the motivating factor for the decision. An illegitimate reason would be failure to promote because of a gender stereotyping such as a woman not dressing and talking more femininely.. A legitimate reason would be a failure to promote a woman because she is abrasive with staff members.
