Answer to Question 1

The source of the arbitrator's authority is the collective bargaining agreement. In this agreement the company agreed not to discipline employees without just cause. The parties agreed to follow a grievance procedure ending in arbitration should an employee or the union believe that the company had violated the agreement. The arbitrator's authority springs from the agreement. The issue before the arbitrator as framed by the parties is tied to the agreement language of just cause.
