No. In order to utilize this defense, Local 164 needed to establish that its claim of
substandard wages and benefits are made in good faith and are based on actual
knowledge gleaned from sufficient investigation of conditions existing at the time the
picketing is initiated against the targeted employer.. The court found that the claims
were unsubstantiated. It is not common to find area standards picketing involving one
union protesting a lack of standards in another union.
