The Babcock rule is that an employer cannot be compelled to allow distribution of union literature by nonemployee organizers on their property. The exception to the rule is that where the location of the plant and the living quarters of the employees place the employees beyond the reach of reasonable union efforts to communicate with the employees, employers' property rights may be required to yield to the extent necessary to permit communication of information on the right to organize.

Answer to Question 2

Picketing provides an opportunity for diverse groups to express their ideas publicly. Unions may publicize their position by picketing. While not commonly exercised, employers also have the right to picket to express their views on a labor dispute. Employers often express their view of a labor dispute through other means, however, such as by newspaper advertisements.
