Performance Monitoring. The Communications Operations Division (COD) of the Milwaukee Police Department (MPD) received incoming emergency calls and coordinated the dispatch of officers. All incoming emergency calls were taped. The taping system was in a glass case in the middle of the COD work area. Also, the employees knew that their supervisors might monitor their calls for evaluation and training purposes. Cynthia Griffin, a COD telecommunicator, filed a suit in a federal district court against the MPD and her supervisors, alleging that they had illegally monitored her personal calls. For what reasons might the court rule in favor of the defendants?

Answer to Question 1

Performance monitoring
The defendants filed a motion for summary judgment, which the court granted, and Griffin appealed. The U.S. Court of Appeals for the Seventh Circuit affirmed the lower court's decision. The appellate court pointed out that the defendants informed COD telecommunicators and dispatchers (including Griffin) that workstation telephone calls might be monitored for training, evaluation, and supervision purposes.    In addition, the defendants told employees that incoming emergency calls would be recorded. The    recording system was located conspicuously in a glass case in the middle of the telecommunicator and dispatcher work area. From these facts, the court concluded that the defendants' systematic monitoring of workstation telephones occurred with Griffin's consent.
