Answer to Question 1

Employers whose employees misappropriate trade secrets for their own use or for the benefit of a new employer, are entitled to obtain an injunction (court order) putting a stop to such illegal behavior.

Answer to Question 2

Many courts shy away from this tort because of problems of proving the extent of the plaintiff's suffering and/or the causal connection, particularly where the defendant never intended to cause the harm.
