Jones, a landlord, requires in all leases that rent be paid on the first day of each month. For the past three months, Jones has accepted Tenant One's rent as late as the 12th day of the month. During the fourth month, when Jones has not received Tenant One's rent, she sends a notice of termination on the second day of the month. Is Jones acting properly?

No. Jones has waived timely payment and must use the fourth month to reinstate the right to receive rent on the first. The earliest a notice of termination could be sent is the 12th day.
