Jenna works for Mega Corp as a production employee. She is paid an hourly wage. She wishes to negotiate her own employment contract with management since she does not agree with the terms of her union's collective bargaining agreement. Can Jenna negotiate her own contract? Explain.

No. Once Jenna's union was certified as the official representative of Mega Corp's employees (or, at least, a certain group of employees within the company), then the union has the exclusive right to negotiate the employment contract for that class of employees. It would be a violation of federal law (Section 9 of the National Labor Relations Act of 1935 ) if the company negotiated individually with Jenna. The principle of exclusivity is illustrated by this situation.
