Answer to Question 1

According to FRE 401, relevant evidence must have the tendency to make a fact more or less probable than it would be without the evidence, and the fact must be of consequence in determining the action. As a general principle, all relevant evidence is admissible unless it is inadmissible due to another rule of evidence or law. FRE 403 allows relevant evidence to be excluded if its probative value is substantially outweighed by danger of unfair prejudice, of confusing or misleading the jury, or of wasting the court's time. The presentation of evidence is subject to objection by the opposing party. The basis of an objection must be stated (for example, prejudice or hearsay) and will be ruled on by the court-overruled or sustained. In addition to probative value exclusions, many social policies operate to exclude relevant evidence.
