a. Discuss the origins of the court-packing scheme as growing out of judicial resistance to many of the policies of the New Deal proposed by Roosevelt, highlighting the significance of Black Monday when the Supreme Court announced three major decisions, all against the administration.
b. Explain the court-packing scheme as an attempt by Roosevelt to exert control over the Supreme Court and build a favorable majority by adding a new justice for every sitting justice over the age of 70, as well as his public arguments for doing so.
c. Describe the pushback by both Congress and the public as illustrated by public opinion polls showing a lack of public support and a refusal by Congress to even consider the proposal.
d. Assess the outcome of the actions,noting that even though the attempt failed, within months the Supreme Court became more supportive of the administration's positions in Court.
e.Note thatthe action demonstrated both that presidential overreach would lead to a sharp institutional rebuke and that the Court cannot resist presidential power grabs without offering compromises.
