You are assisting a person with range-of-motion (ROM) exercises. The person does not want to participate and tells you to leave the room. Does the person have the right to refuse? What will you do? Does the nursing center have to take action?

You are working in a long-term care center and a surveyor asks you a question. You are unsure of the answer. You worry your response may cause your facility to get in trouble or you could get in trouble for answering incorrectly. How will you respond?

Answer to Question 1

The person has the right to refuse. You should reintroduce the action at a later time. Report the refusal to the nurse. The nursing center may have to take action if the person is there to receive rehabilitation care. If a person will not perform certain tasks to assist in maintaining or improving his or her health status, the nursing center could become liable. The physician may need to become involved to reevaluate goals of care for the person.

Answer to Question 2

Remain calm. Always be professional, courteous, and honest. Make sure you fully understand the question and if needed repeat the question in your own words for clarification. If you do not know the answer but know where the information may be located, for instance your facility has a policy manual and you know where it is located and the question was a policy question, you may tell the surveyor you would locate the answer in the manual. You could also tell the surveyor you would ask the nurse.
