Battery is an intentional tort for which an action can be brought. Intent or insurance does not need to be present for a personal to recover damages as the result of alleged malpractice.

Assessing the patient is the highest priority. The physician must be notified after the patient is assessed. Filling out an incident report and telling the supervisor are not priorities.
