HIPAA allows for electronic communication and client input does not have to be obtained at every stage of care planning. A facility does not necessarily have to make copies of client records prior to transfer.

Before involuntary commitment, clear and convincing evidence must be used as the standard of proof in a civil hearing to determine if a person is mentally ill and dangerous to self or others.
