Answer to Question 1

For a construction contract to not be slanted against the contractor it should include a statement that absolves the contractor of responsibility for checking the design drawings of the engineer.

Answer to Question 2

If an indemnity clause is present this clause will state that the contractor indemnifies the owner, which means that the contractor is taking on the liability of the owner in addition to his or her own liability. If a contractor agrees to a contract that includes an indemnity clause it could result in the contractor raising the price of the contract in order to account for the additional risk they would be absorbing by taking on the liability of the owner in addition to their own liability.
