Answer to Question 1

James Madison, the chief architect of the Bill of Rights, initially stated that a a bill of rights was unnecessary, because it was evident that the general government had no power but what was given it by the Constitution and dangerous, because an enumeration which is not complete is not safe. By omitting a bill of rights, some framers argued that citizens could always claim, in the face of governmental intrusion, that because citizens did not specifically limit the nature and extent of their freedoms, they reserved the right to do what they pleased.

Answer to Question 2

The Supreme Court has identified a number of rights that are protected under the Bill of Rights even though they are not specifically listed in the document. These include the right to privacy, the right to marry, the right of adults to engage in consensual sexual activity with other adults, and the right to travel freely among the United States.
