The potential defenses in a defamation case include immunity under  230 (Section 230) of the Communications Decency Act (CDA), privileges, opinion, truth, consent, and anti-SLAPP (strategic lawsuit against public participation) legislation.

Answer to Question 2

Actual malice is knowledge of falsity or reckless disregard for the truth as set forth in the U.S. Supreme Court case New York Times Co. v. Sullivan, 376 U.S. 254 (1964).
