Answer to Question 1

In Gonzales v. Carhart (2007 ), the U.S. Supreme Court examined the federal Partial-Birth Abortion Ban Act of 2003. Under this Act, Congress outlawed the so-called partial-birth abortions (properly known as intact dilation and evacuation procedures), but did not provide for an exception in cases where the health of the pregnant woman is in jeopardy. In a 54 ruling, the Court concluded the law's failure to include a health exception did not impose, at least based on the facial language of the statute, an undue burden on a woman's right to an abortion. The Court, however, noted that, if a case were presented where the medical science clearly demonstrated that the banned procedure was necessary to preserve a woman's health, the law's applied prohibition would be unconstitutional. But in Carhart, the Court found that such health risks were not clearly demonstrated.
