Different justices use different methods to determine what activities are protected under the liberty provision of the due process clause. Some have found liberties implicit in the Bill of Rights. Other justices have used a strict constructionist approach that construes the explicit words of the Constitution to determine whether a particular liberty is protecte.DOthers apply original intent (assess what the authors of the due process clause meant or intended by the term liberty) or original understanding (assess what governments understood liberty to mean when the due process clause was ratified).
