Answer to Question 1

Police are required to provide suspects with Miranda warnings when they are conducting a custodial interrogation of a suspect. The Miranda warnings are designed to ensure that prior to police questioning, individuals are informed of two basic rights under the Constitutionthe right to be silent and the right to an attorney.

Answer to Question 2

The automobile exception is an exception to the warrant requirement that allows police to search a vehicle without a warrant if they have probable cause to believe that the vehicle or part thereof contains evidence of criminality. The U.S. Supreme Court has theorized that this exception is appropriate because vehicles can be readily moved, thereby making the acquisition of a warrant impractical. The Court also has suggested that people have a lesser expectation of privacy in their automobiles because they are used among the public and on public roads.
