Answer to Question 2

Arizona v. California represents a valid delegation. The Secretary of the Interior was delegated considerable authority over the apportionment of water from the Colorado River by the Boulder Canyon Project Act. The delegation was upheld because the statute ordered the secretary to consider various factors when deciding priority for water use. For example, he was ordered to consider river regulation, flood control, irrigation, domestic water consumption, and power production needs. The Court found that this provided the secretary with sufficient standards from which to work. If Congress had simply left the decision to the secretary's discretion, without listing the factors to be considered, the delegation would have failed.
