Defendants may plea bargain to minimize their sentences and avoid the harmful effects of a criminal conviction or protect accomplices or confederates. The prosecution can benefit if the case is weak and trial is too risky; if arresting officers made a serious procedural error, a plea voids all prior constitutional errors made in that case; and if bargaining gains the cooperation of the defendant against his or her accomplices, informers, and codefendants. Plea bargaining also saves time and money when resources and personnel are lacking.
