Victims have the following rights during sentencing in most state courts: (1) the right
to be treated with dignity and compassion, (2) the right to protection from intimidation
and further harm, (3) the right to receive compensation for damages, (4) the right to
equal treatment in court, and (5) the right to have their property returned promptly, if
found by the police. This has affected sentencing hearings by providing time at the
hearings for the victims to speak and have input in the judge's decision.
