Answer to Question 1

Breathalyzer tests are so readily admissible because they have been shown to be
very accurate, as long as they are properly calibrated and properly used, thus
meeting both the Frye and Daubert standards. The legal issues that persist are
about the fairness of the administration of the tests and whether the procedures
required by state law have been followed.
