Selective incorporation is based on the concept that only fundamental rights in the
Bill of Rights should be applied to the states. An example of that is the right to an
attorney, which is one of the rights contained in the Bill of Rights, that was selected
by the U.S. Supreme Court, to apply to the states through the Fourteenth
Amendment due process clause.

Answer to Question 2

The concept of dual sovereignty is that federal and state governments are each
considered sovereign in their own right. In the Oklahoma City bombing, one of the
defendants was convicted in federal court and later also convicted in state court.
