Answer to Question 1

Regarding freedom of speech, the courts have ruled that the limitation of First Amendment freedoms must be no greater than is necessary or essential to the protection of the particular government interest involved. Specifically, mailed publications must meet criteria to be acceptable into a prison institution. Inmates do not have a right to correspond with other inmates. Inmates are entitled to have legal materials available and to be provided with assistance in drawing up complaints.

Answer to Question 2

In the past, prisons were separated based on race. Today, segregation is only allowed if a prison administrator can prove that there is a compelling interest in prison safety. There are risks in not separating races when there is high tension or issues between two or more races within the prison. When safety and security of a prison is at risk because of racial tension, it may not be a bad idea to segregate people from one another.
