There are several types of warrantless searches. Pick one type and summarize the circumstances needed for that type of warrantless search. Write a mini-case example involving that type of warrantless search. Be sure to include the reason why your case example meets the requirements for a warrantless search.

Answer: The Fourth Amendment says that all searches must be preceded by the officer's obtaining a search warrant. Regardless of how much probable cause an officer may have, if he or she searches without a search warrant, there is a legal presumption that the search is unconstitutional. There are several conditions in which warrantless searches are authorized and they include: consent searches, searches under exigent circumstances, searches incident to lawful arrest, stop-and-frisk searches, plain-view searches, and automobile searches. Examples of the mini-cases will vary.

Answer: Cases and answers will vary. Conditions in which deadly force can be applied include the person fleeing from the police, the person assaulting someone, or attempting to use lethal force against another person (including the police officer). Students may also apply the decision model of ability, opportunity, and jeopardy in their analysis.
