Extralegal factors include: differences race, ethnicity, socioeconomic status, gender, sexual orientation. Use of discretion by law enforcement officers can play a divisive role in the community and create an us versus them attitude. Discretion can be the result of numerous community, organizational, and individual influences outside of the formal legal codes.
