The purpose of criminal pretrial and trial processes is to protect the defendant's rights under the Constitution and to ensure justice. At trial, a defendant may be found guilty or not guilty, or the case may be dismissed.
In civil cases, a complaint (lawsuit) is initiated by a plaintiff, claiming a civil wrong committed by the respondent in the case. A civil lawsuit is not a criminal prosecution. Procedurally, a civil lawsuit parallels, but does not replicate, a criminal prosecution.
