Answer to Question 1

b

Answer to Question 2

The admissibility of scientific evidence was only possible once the process or theory had received general acceptance in the scientific community. This was known as the Frye test. More recently, however, the Court has applied a relevancy test that allows the trial judge to permit any expert testimony deemed germane to the matter at hand. This standard, known as the Daubert standard, is used by the federal court and most state courts. Thus, the proliferation of scientific evidence being introduced is growing. The introduction of new technologies and the increasing reliance upon them will continue to produce new lines of scientific inquiry.
