This practice is all but mandatory in American courts of law as elevated caseloads encourage any action that would streamline the criminal justice process. Imagine a system in which the smallest, least significant fact had to be formally proven and how much time it would take. Judicial notice exists in a climate in which procedural safeguards attempt to ensure fundamental fairness to criminal defendants.There are four general areas of judicial notice: legislative facts, adjudicative facts, political facts, and matters of law.
