Answer to Question 2

The public and fellow employees have a right to have trains operated in a safe manner by employees who are properly qualified to operate the trains. The Hours of Service Law restricts train operating personnel to no more than twelve hours of work without a minimum eight hours of rest in the interest of public safety. Also, in the interest of public safety, an employer may require that its employees not consume alcoholic beverages during the appropriate period of time prior to their reporting to work.
