The employer Spears recorded and listened to the entirety of 22 hours of personal conversations. Such a surreptitious monitoring of phone conversations which were clearly personal calls was intrusive on the employee's privacy and was well beyond the boundaries of the ordinary course of business exemption in the federal wiretapping law.
