Section 4(f) of the ADEA allows employers to terminate protected employees for reasonable factors other than age (RFOA). The employer may terminate some older employees in a RIF along with other employees so long as the terminations are not based on age; that is, if the employer uses a performance appraisal along with recognition of seniority or length of service, as set forth in the text, terminating a significant number of older employees is a risky matter because statistical and other evidence may tend to show that the terminations were based on age.
