In the U.S. Supreme Court's decision in PriceWaterhouse v. Hopkins, 490 U.S. 228 (1989),
the Court ruled in favor of a female who was denied a partnership in an accounting
firm because she was a forceful and aggressive woman who did not match gender
stereotypes. Courts have recognized claims for gender stereotyping by transgender, and
gay and lesbian employees on this theory. However, the courts require pleadings and
significant proof that the harassment or adverse action was based on a plaintiff's failure
to conform to gender stereotypes and not merely on his or her sexual orientation.
