In order to secure a warrant after this decision, must the Secretary demonstrate probable cause to believe the conditions in violation of OSHA exist on the premises?

No. The Secretary does not have to demonstrate probable cause to believe the conditions in violation of OSHA exist on the premises. Rather, it is sufficient that reasonable legislative or administrative standards for conducting an . . . inspection are satisfied with respect to a particular (establishment)..
