Answer to Question 1

The principles, which are adopted from the Sinclair dissent, are as follows:
(a) The strike must be over a grievance that both parties are contractually bound to arbitrate.
(b) The employer should be ordered to arbitrate as a condition of obtaining an injunction against the strike.
(c) The injunction must be warranted under ordinary principles of equity.
(d) Breaches of the no-strike clause either are occurring and will continue or have been threatened and will be committed.
(e) They have caused or will cause irreparable injury to the employer.
(f) The employer will suffer more from the denial of an injunction than the union will from its issuance.
