Answer to Question 1

Thornhill, a union member, was one of a number of picketers at the plant of Brown Company.
Because he sought to influence nonunion workers entering the plant, he was arrested and charged. The persuasion was peaceful and not intimidatory in character.

Answer to Question 2

Section 3448 in effect prohibited all forms of picketing.
