The Court states that it sees no escape from conflicts flowing from the Board's exercise of jurisdiction over teachers in church-operated schools and the consequent serious First Amendment religion clauses questions that would follow.

Answer to Question 2

Yes. The Court refers to the concurring opinion of Mr. Justice Douglas in Lemon v. Kurtzman that the raison d'etre of parochial schools is the propagation of religious faith.
