The non-statutory labor exemption was created by the Supreme Court to avoid the application of federal antitrust laws to multiemployer collective bargaining activities with union, dealing with wages, hours, and working conditions. Without this exemption, antitrust laws might apply to certain multiemployer bargaining agreements even though federal labor policy favors such bargaining.
