Answer to Question 1

FALSE

Answer to Question 2

After the election is held, the parties have five days in which to file any objections with the regional director. If the director finds the objections to be valid, the election will be set aside. If the objections are held to be invalid, the results of the election will be certified. To be victorious, a party to the election must receive a majority of the votes cast; that is, either the union or the no-union choice must garner a majority of the votes cast by the eligible employees. If the election involved more than one union and no choice received a simple majority, the Board will hold a run-off election between the two choices getting the highest number of votes. If a union wins, it will be certified as the bargaining agent for all the employees in the bargaining unit.
